Our expertise in litigation
is reflected in our firm obtaining one of the thirty
largest judgments in United States history up to that
time, for $129 million, against major firms. We
have also won a $55 million judgment against major
Philadelphia and San Francisco firms, which was one
of the largest forty judgments in 2001, and in
another case a $45 million settlement. In the
appellate area, we have won business litigation
involving securities fraud, problems with sales of
businesses and earnouts, and minority freezeouts. Our
attorneys in this field are Richard L. Brittain, Wendell R. Bird and outside counsel.
Richard L. Brittain has
practiced in the litigation field for 20 years.
He, along with Wendell Bird, won a $55 million
judgment in 2001. He is a member of the bars of
the U.S. Court of Appeals for the Eleventh Circuit
and of various U.S District Courts. He and
Wendell Bird handle appeals as well as trials.
Wendell R. Bird has
litigated for over 25 years, is listed in America's Premier
Lawyers, and is a member of the bar of
the U.S. Supreme Court, of the bars of the U.S.
Courts of Appeals for the Second, Third, Fourth,
Fifth, Sixth, Seventh, Eight, Ninth, Tenth, and
Eleventh Circuits, and of the bars of various U.S.
District Courts. He is also a member of the
Section of Litigation of the American Bar Association.
Wendell Bird served as law clerk for a judge on the U.S.
Court of Appeals for the Fifth (now Eleventh) Circuit,
and for another judge on the U.S. Court of Appeals
for the Fourth Circuit. In one year, he
had the privilege of briefing and arguing one case of
the 160 cases argued in the United States Supreme
Court, and of briefing a second of those cases as
well. He has published articles on
constitutional law in the Yale Law Journal,
Harvard Journal of Law and Public Policy, and
elsewhere.
He has taught a litigation-related course on
constitutional law at Emory Law School , and designed
and edited the course materials.
Our firm periodically has associated three
experienced trial counsel in cases: a former President of the California Association of
Trial Lawyers, a former District Attorney in state
courts, and a former Assistant United States Attorney
in federal courts.
